I, (the “Volunteer), execute this Release and Waiver of Liability (the "Release") in favor of
the Friends of the Arlington Public Library ("FOAL"), a nonprofit corporation, and its directors, officers, employees, and agents.
The Volunteer desires to work as a volunteer for FOAL and engage in activities related to being a volunteer for the FOAL Book Sale (the "Activities"). The Volunteer understands that the Activities may include lifting heavy books, shelving heavy books, moving heavy books, packing and unpacking books into and out of bags and or boxes, and otherwise engaging in the sale of books to members of the public.
The Volunteer hereby freely, voluntarily and without duress executes this Release under the following terms:
1. Release and Waiver: Volunteer does hereby release and forever discharge and hold harmless FOAL and its successors and assigns from any and all liability, claims and demands of whatever kind or nature, either in law or in equity, that arise or may hereafter arise from Volunteer's Activities with FOAL.
VOLUNTEER UNDERSTANDS THAT THIS RELEASE DISCHARGES FOAL FROM ANY LIABILITY OR CLAIM THAT THE VOLUNTEER MAY HAVE AGAINST FOAL WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM VOLUNTEER'S ACTIVITIES WITH FOAL WHETHER CAUSED BY THE NEGLIGENCE OF FOAL OR ITS OFFICERS, DIRECTORS, BOARD MEMBERS, EMPLOYEES, AGENTS, OR OTHERWISE. VOLUNTEER ALSO UNDERSTANDS THAT FOAL DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE IN THE EVENT OF INJURY OR ILLNESS.
2. Medical Treatment: Volunteer does hereby release and forever discharge
FOAL from any claim whatsoever which arises or may hereafter arise on account of any first aid treatment or service rendered in connection with the Volunteer's Activities with FOAL.
3. Assumption of Risk: The Volunteer understands that the Activities may involve work that may be hazardous to the Volunteer, including but not limited to, lifting heavy books, shelving heavy books, moving heavy books, packing books into bags and or boxes, and otherwise engaging in the sale of books, and transportation to and from the work sites. Volunteer hereby expressly and specifically assumes the risk of injury or harm from the Activities, and releases FOAL from all liability for injury, illness, death, or property damage resulting from the Activities.
4. Insurance: The Volunteer understands that FOAL does not carry or maintain health, medical, or disability insurance coverage for any Volunteer. Each Volunteer is expected and encouraged to obtain his or her own medical or health insurance coverage.
5. Other: The Volunteer agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Virginia. The Volunteer also agrees that in the event that any clause or provision of the Release shall be held invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not affect validity of the remaining provisions of this Release which shall continue to be enforceable.
6. Behavior: The Volunteer understands that he or she is a representative of the library while volunteering and will treat customers and coworkers respectfully. Failure to adhere to appropriate standards of behavior may result in the Volunteer being prohibited from volunteering at future FOAL events.
7. Duration: This Release covers all Activities between the date it is signed and December 31 of the calendar year in which it is signed.
